Terms of Service

Welcome to VolleyHQ. These Terms of Service (“Terms”) govern your access to and use of the VolleyHQ platform, website at volleyhq.app, mobile application, and related services (collectively, the “Platform”) operated by VolleyHQ (“VolleyHQ,” “we,” “us,” or “our”).

By creating an account, accessing the Platform, or clicking “I Agree,” you confirm that you have read, understood, and agreed to these Terms and our Privacy Policy. If you do not agree, you may not use the Platform.


1. Eligibility

You must be at least 13 years of ageto use VolleyHQ. Users between the ages of 13 and 17 must have the consent of a parent or legal guardian, who accepts these Terms on the minor’s behalf and is responsible for the minor’s use of the Platform. By registering, you represent that you meet this age requirement.

We do not knowingly collect personal information from children under 13. If we discover that a user is under 13, we will promptly terminate their account and delete associated data in accordance with the Children’s Online Privacy Protection Act (“COPPA”).

You must be capable of forming a binding contract under applicable law, and must not be barred from receiving services under any applicable law.


2. The VolleyHQ Platform — Marketplace, Not Event Organizer

VolleyHQ is a technology platform and marketplace. We connect players, coaches, and event organizers. We do not organize, sanction, supervise, sponsor, manage, or control any volleyball tournament, league, pickup game, tryout, clinic, or other sporting event (“Event”) listed on the Platform.

All Events are independently created and operated by third-party organizers (“Organizers”) who are solely responsible for: planning and executing the Event; compliance with applicable laws and venue rules; participant safety; waiver collection; prize distribution; refunds; and all other Event-related matters.

VolleyHQ makes no representations or warranties regarding the quality, safety, legality, or any other aspect of any Event, venue, or Organizer. We are not a party to any agreement between you and an Organizer.


3. Assumption of Risk — Physical Activity

Volleyball, beach volleyball, and other sports involve inherent risks of injury, including but not limited to sprains, fractures, concussions, abrasions, heat illness, and death. By using the Platform to participate in any Event or physical activity, you voluntarily and knowingly assume all risks associated with such activities, whether or not those risks are foreseeable at the time of participation.

You acknowledge that VolleyHQ has no ability to control the conditions at any venue, the conduct of other participants, the competence of Organizers, or any other factor that could contribute to injury or harm. Your participation is entirely at your own risk.

Nothing in these Terms limits or alters any event-specific waiver you may sign directly with an Organizer. You should review all event-specific waivers carefully before signing.


4. Accounts and Registration

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately at legal@volleyhq.app if you suspect unauthorized access.

You agree to provide accurate, current, and complete information during registration and to keep it updated. Providing false information — including misrepresenting your age — is a material breach of these Terms and grounds for immediate account termination.

You may not create more than one account, transfer your account, or use another person’s account without authorization. VolleyHQ reserves the right to suspend or terminate accounts that violate these Terms.


5. Organizer Responsibilities

If you use the Platform to create or manage Events as an Organizer, you additionally agree:

  • You are solely responsible for all aspects of your Event, including participant safety, venue compliance, permits, insurance, and all applicable local, state, and federal laws.
  • You will not misrepresent the nature, rules, prize structure, or any material aspect of your Event.
  • You will promptly refund participants in the event of cancellation or material change, per applicable law.
  • You will obtain all necessary releases, waivers, and consents from participants, including parental consent for minor participants.
  • You will maintain adequate liability insurance for your Event where required by law or venue.
  • You grant VolleyHQ a non-exclusive, royalty-free license to display your Event information on the Platform for the purpose of facilitating registrations.

VolleyHQ reserves the right to remove any Event listing that violates these Terms or that we determine, in our sole discretion, is unsafe, fraudulent, or otherwise inappropriate.


6. Payments

Certain features — such as tournament registration fees — may require payment. Payment processing is handled by Stripe, Inc. (“Stripe”) in accordance with Stripe’s Terms of Service. VolleyHQ is not responsible for Stripe’s processing errors, outages, or disputes.

All fees are set by Organizers. VolleyHQ may charge a platform service fee which will be disclosed at checkout. All fees are in US Dollars unless stated otherwise.

Refund requests for Event fees must be directed to the Organizer. VolleyHQ does not control Organizer refund policies. If an Organizer fails to issue an eligible refund, contact us and we will use reasonable efforts to assist, but VolleyHQ is not liable for Organizer refund failures.


7. User Content

You retain ownership of content you submit to the Platform (“User Content”). By submitting User Content, you grant VolleyHQ a worldwide, non-exclusive, royalty-free, sublicensable license to use, reproduce, modify, distribute, display, and publish your User Content solely for the purpose of operating and improving the Platform.

You represent that you own or have the necessary rights to your User Content, that it does not violate the rights of any third party, and that it complies with these Terms.

Prohibited content includes: content that is illegal, harassing, defamatory, obscene, fraudulent, or that infringes intellectual property rights; false or misleading information about Events or players; and any content that promotes violence or discrimination.


8. Prohibited Conduct

You agree not to:

  • Use the Platform for any unlawful purpose or in violation of these Terms
  • Impersonate any person or entity, or misrepresent your affiliation
  • Scrape, crawl, or harvest data from the Platform without written permission
  • Reverse engineer, decompile, or attempt to access source code of the Platform
  • Interfere with or disrupt the Platform’s operation or servers
  • Use the Platform to transmit spam, malware, or unsolicited commercial messages
  • Manipulate ratings, rankings, or other player statistics
  • Create fraudulent Events or misappropriate registration fees
  • Use the Platform to engage in harassment, discrimination, or hate speech

9. Intellectual Property

The Platform, including its design, software, trademarks, and content created by VolleyHQ, is owned by VolleyHQ and protected by applicable intellectual property laws. You may not use our trademarks, logos, or branding without our prior written consent.

If you believe content on the Platform infringes your copyright, please send a DMCA notice to legal@volleyhq.app with the information required under 17 U.S.C. § 512(c)(3).


10. Third-Party Links and Services

The Platform may contain links to or integrations with third-party services (maps, payment processors, weather providers, etc.). VolleyHQ does not endorse and is not responsible for any third-party service, its content, or its practices. Your use of third-party services is at your own risk and subject to those services’ own terms.


11. Disclaimer of Warranties

THE PLATFORM IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, VOLLEYHQ EXPRESSLY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY. VOLLEYHQ DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

VOLLEYHQ MAKES NO WARRANTY AS TO THE ACCURACY OF ANY EVENT INFORMATION, ORGANIZER REPRESENTATIONS, VENUE CONDITIONS, OR USER-GENERATED CONTENT. YOU RELY ON SUCH INFORMATION AT YOUR OWN RISK.


12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, VOLLEYHQ AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM: (A) YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) THE PLATFORM; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY OR ORGANIZER; (C) ANY CONTENT OBTAINED FROM THE PLATFORM; (D) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT; (E) PERSONAL INJURY OR PROPERTY DAMAGE ARISING FROM YOUR PARTICIPATION IN ANY EVENT; OR (F) ANY OTHER MATTER RELATING TO THE PLATFORM.

IN NO EVENT SHALL VOLLEYHQ'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE GREATER OF (A) ONE HUNDRED DOLLARS ($100.00) OR (B) THE AMOUNTS YOU HAVE PAID TO VOLLEYHQ IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, VolleyHQ’s liability is limited to the fullest extent permitted by law. Nothing in these Terms limits liability for: (i) death or personal injury caused by VolleyHQ’s gross negligence or willful misconduct; or (ii) any other liability that cannot be excluded or limited under California law.


13. Indemnification

You agree to indemnify, defend, and hold harmless VolleyHQ and its officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, losses, and expenses — including reasonable attorneys’ fees — arising out of or in connection with:

  • Your use of or access to the Platform
  • Your User Content
  • Any Event you organize or administer
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Any injury to a participant or third party at an Event you organized

14. Dispute Resolution and Arbitration

Please read this section carefully — it affects your legal rights.

Informal Resolution. Before initiating any formal proceeding, you agree to contact us at legal@volleyhq.app and give VolleyHQ 30 days to attempt informal resolution of your dispute.

Binding Arbitration.If informal resolution fails, any dispute, claim, or controversy arising out of or relating to these Terms or the Platform shall be resolved by binding individual arbitration administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules, rather than in court. The arbitration shall take place in Los Angeles County, California, or remotely at your election.

Class Action Waiver. You and VolleyHQ each waive any right to participate in a class action lawsuit or class-wide arbitration. All disputes must be brought in an individual capacity. If a court finds this waiver unenforceable, the arbitration agreement shall be null and void as to that dispute.

Exceptions. Either party may seek emergency injunctive relief from a court of competent jurisdiction to prevent imminent harm, without waiving the right to arbitrate.


15. Governing Law

These Terms are governed by the laws of the State of California, without regard to its conflict of law principles. To the extent any claim must be heard in court (e.g., where arbitration is unenforceable), you consent to the exclusive jurisdiction of the state and federal courts located in Los Angeles County, California.

California Residents: Under California Civil Code Section 1789.3, California users may report complaints to the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs by contacting them in writing at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by telephone at (800) 952-5210.


16. Termination

VolleyHQ may suspend or terminate your account at any time, with or without cause or notice, in its sole discretion. Grounds include violation of these Terms, fraudulent conduct, or any activity that VolleyHQ believes poses a legal risk or harm to other users.

Upon termination, your right to access the Platform immediately ceases. Sections 3, 9, 11, 12, 13, 14, 15, and 17 survive termination.


17. Modifications to These Terms

VolleyHQ may update these Terms at any time. We will notify you of material changes by posting a notice on the Platform and updating the “Last Updated” date above. If we make material changes, we will also send notice to the email address associated with your account. Your continued use of the Platform after the effective date of changes constitutes acceptance of the new Terms.


18. Miscellaneous

  • Entire Agreement. These Terms, together with the Privacy Policy and any event-specific waivers, constitute the entire agreement between you and VolleyHQ regarding the Platform.
  • Severability. If any provision of these Terms is found unenforceable, the remaining provisions remain in full force.
  • Waiver.VolleyHQ’s failure to enforce any right or provision is not a waiver of that right.
  • Assignment.You may not assign your rights or obligations under these Terms without VolleyHQ’s prior written consent. VolleyHQ may assign freely.
  • Force Majeure. VolleyHQ is not liable for delays or failures resulting from causes beyond its reasonable control.
